⠀Every time you want to request a commission, it is recommended to read this section again.

• You must be 18 years old or older to commission work from me.

• You acknowledge that I'm a digital illustrator and my work is digital only,
⠀meaning there won't be any shipping of physical goods.

• My work is for personal or private use only,
⠀meaning i do not allow my art to be used for unauthorized commercial purposes or profit unless commercial usage is specifically accorded at the time the order is made.

• As the artist i still mantain all and absolute rights to my works;
⠀this includes publishing the work on my socials and adding it as a part of my portfolio, unless otherwise accorded with the client.

• Neither commissioner nor anyone else is allowed to edit, trace, copy, or remove the watermark from the finished product.
⠀You're not allowed to claim my art as your own, even in the case of a paid commission.
⠀Credits to me ( ©amuchipuchi; the artist) or a link going back to one of my socials must be explicitly given anytime the art is showcased.

• No one is allowed to mint my artwork as a NFT (Non Fungible Token);
my art, wether commissioned, pre-existing or future, can not be minted into an NFT by commissioner nor anyone else.. I strictly prohibit usage for AI learning.

• I may deny your commission if I feel that I'm unable to fulfill your expectations.

• Full payment will be sent beforehand,
⠀and via Paypal invoice.

• Prices are all in EURO €.

• Prices are just a starting points.
It will raise depending on the complexity of the commission.

• Payment must be sent after the references are presented or I will not proceed.

• Don't send me any payment before I have agreed to give you a slot.
⠀If your commission is accepted, I will send you the invoice.

• Refunds can be requested if the commission has not been started(sketch). No refunds otherwise.
⠀You can ask about your commission status or for WIPs anytime you desire.

• If you are getting a refund, do not request a Paypal chargeback.
⠀I will transfer the money back to you myself.

• 1.5x price: Promotional Material/Streaming Assets.
(Twitch, YouTube, Website, VTuber branding).

⚠️ If the character that is drawn is Vtuber or in the future will be Vtuber, the extra commercial rights will ALWAYS be charged.Why? - The image of a Vtuber is considered a brand. The vtubers earn money with their image, therefore the use of the drawing is no longer personal. It is also very probable that the drawing is used in a stream or as a decoration for schedules, so it is used commercially or promotionally.
I can't keep a record to verify that all my drawings are being used correctly, so I prefer to charge extra so that clients can use my drawing however they want.

• 3x price: Game art/Merch.
(Illustrations or character design for games | Printed Goods: Posters, cards, key chains, pins, badges etc).

• Waitlist are always OPEN for returning customers!
⠀Frequent customers are marked with "♚" on the waiting list.

• Commissions are usually made in order of arrival,
⠀but orders with a deadline will always have priority.

• If you want the commission to have priority and add a deadline, you must pay an extra.

If you request a Paypal chargeback at any point when you were not allowed to ask for a refund or you break any of the terms above mentioned, you will automatically lose all beforementioned rights to the commissioned piece.

• I will have the full right to profit further from it in any way I find fit.

• I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you.

• Consequently you will be blocked and you will not be able to commission or buy any products as adoptables created by me.

• After purchase you will be sent the unwatermarked digital file of the adoptable in full resolution.
⠀If the adoptable has different versions or art included, it will also be added in the mail or together with the other files on the platform to be able to download them.

• No physical item will be shipped.
⠀All files are digital products.

• Resell or trade the adoptable to other people.
⠀Regarding reselling, DO NOT sell it higher than its selling price.
⠀You may raise the price if you have commissioned extra art for the said adopt; but do not force the person to pay for the art if they absolutely CANNOT use it (e.g. old couple art).
⠀As the previous owner, please inform us when and to whom the adopt is sold or traded so we can keep track of the ownership.

• Give the adopt a name, decide its gender, personality, give it AUs, etc.
⠀Treat it like your own character.

• Make minor edits to the adopt and provide other outfits.
⠀Please do not change everything to a point of it being unrecognizable. If the original file is edited, contact us for approval.

• Co-own the adopt with another person.
⠀However before reselling/trading the design, both owners must contact us.

• Use vouchers within reasonable agreement between both parties,
⠀but please inform the people involved of the monetary value of the design.

• Use the design for commercial use (only if the extra has been paid)
⠀through new artwork (e.g. artbooks, games, prints, merch, etc), but please inform us first and credit us properly for the design.However this does not include usage in NFTs.
⠀Any designs and art made by © Amuchipuchi are NOT authorized for use in any blockchain-related technology including NFTs and any form of cryptocurrency.

• Claim the original design as yours..
⠀Even if purchased with commercial rights the design is still amuchipuchi's creation and credits must be given..

• Refund the adopt once it is sold.
⠀You may however resell/trade it.

• Sell an adopt you got from a free raffle or Offer to Adopt (OTA) if no money was spent.
⠀Adoptables acquired by trade or gift can only be gifted or traded.

• Use the original artwork for commercial use without permission.
⠀(Please discuss with us first).

• Use the designs and works of Amuchipuchi in any blockchain-related technology including NFTs, any form of cryptocurrency and AI learning.
We will not authorize this.

We will be happy if we will be informed about any story, commission, or progress regarding our adopts, so feel free to show us! We hope that they will be given a good home.

• If we find that our terms are violated, the one who committed the violation will be blocked, and won’t be transacted with in the future.

• Your DeviantArt/Toyhou.se account should at least be a year old.
⠀This is to avoid selling adopts to dummy accounts.
⠀However there can be exceptions if you can prove you have a previous account, or an established 1 y/o account (like twitter, FA, etc).
⠀We may also check for any commission/adopt purchase history with your account.

• Be honest and responsible customers, only participate in any transaction only if you are able to pay of your own ability
⠀(have your own paypal account/credit card and not use someone else's especially parents').
⠀Chargebacks against us due to irresponsible buying, will automatically result to a permanent block.

• If we find that you are blacklisted within proper reason from other creators, proven to do bad business practices, or cautioned against with proof; we may decline to transact with you in any way.

• If chargebacks or refunds were done against us, we have the right to revoke the ownership of the design and put the design back on sale.
